Hi,
I applied for H1 and H4 for my Family in 2005. I was working on L visa that time. Our H1 and h4 got approved in October 2005 but we were in India that time. We came to US again on L Visa in 2006.
After coming on L visa my new employer applied for my H1 change of status again in 2006 but not for family. Their H4 from 2005 was valid till 2008.
But Now while I am changing my job, New attorney says that my family is out of status and because we did not file H4 for them again.
What is the alternative to bring them in status. They have vaild i-94 from L2 which is valid till 2009 and they have approved h4 from 2005 which is valid till 2008.
Now my new employer have started my H1 transfer. I am thinking that for my family I will apply H4 change of status once my approval comes. Is that Okay or there is any other alternative to bring them in the status.
My family can not travel to India for H4 stamping till the end of this year. My wife will be delivering a baby in October. Will there be any problem for my new born baby for the passport?
Please advise.

I agree totally!! I understand the need for IV not to lobby for just one community EB2 or
EB3...but the fact is that all we see is movement in EB2 and no to very little movement in EB3....the most retrogessed and most in need community is EB3...
For new people like us, how do we get motivated for donation and all these things when we see rest of the people who are doign this still waiting for months to see some light at the end of the tunnel??
I think what would help is an action plan by IV stating what they would be doing in weeks or months to come....
may be do a campaign like a flower campaign or something to really get the attention if not this beginning of next year, when we think that CIR may be moving....
I think we are lacking an action plan here....and may be thats what we need for new people to get motivated towards....
Well Pappu, the fact of the matter is nothing has been done specifically to help EB3-I/C/ROW. IV may be EB agnostic but EB3-I seems to have been stuck forever to the point of despair.
I and other EB3s have donated to most of the IV causes and campaigns. We have written to our Senators, reps, sponsors and co-sponsors of bills but nothing has helped.
If IV renews its focus to help EB3-I/C/ROW then you can expect more contributiuons from EB3s.
I do not want a lesson on EB3/EB2/EB1...there is no end to opinions on this forum. What I and other EB3-I/C/ROW want are results. Contributions, meeting the lawmakers, writing to politicians etc will kick in fourth gear if there is a reasonable advancement of dates for EB3-I/C/ROW.
BTW, your and other IV leaders' efforts are very much appreciated. All that I am saying is that IV should be focused on EB3-I/C/ROW (through tagging recapture to a bill or something) now that EB2 is getting help from USCIS spillover.

That's why, as a last measure, CHC had to do a press conference on the steps of the Congress to put pressure on the House Leadership/Speaker. It shows that CHC and House leadership are on opposing side of the issue and that is why CHC had to openly show this difference of opinion. It indicates that the House leadership have made a decision about moving forward the Lofgren bills. This news item indicates an excellent development.
And it appears, while CHC is putting pressure on House leadership for not doing Lofgren bills, IV is asking us all to call (and put pressure) on CHC members to support Lofgren bills. Smart move, I will call again today.
lost_stranger, I suggest we not attack the undocumented because it doesn't help us in any way, rather attacking undocumented hurts us all the way. What was in "our" favor in the last stimulus bill? Which bill are you talking about?
They were going to deny immigrants the stimulus rebate in the 2009 bill, but we got them to drop the restriction just before the bill was signed into law. There is a discussion about it in the forum.

I beg to differ from your point of view that approvals are on PD. If you take a good look at the PDs of approved cases posted here, you will there are many post July 04 (mostly in Oct and Dec 04) and we all know there are many before that.
They are clearly going by ND. I have seen 1/2 case approved that had ND after 8/30/07
High number of approvals over the first few days were expected. Centers review/preadjudicate cases based on 'real' receive dates (which are close to notice dates), as physical files are sorted in that sequence. That is happening. Sept VB was available couple of weeks ago, which prepared them to issue formal approvals as soon as September starts. USCIS SOP describes that once cases are preadjudicated they are shelved (wating for visa) in sequence of PD's. Therefore, most approvals are preadjudicated cases.
Congratulations to All who got approved. Best wishes to those still counting. If you ND is not too far from published dates (i.e. it is sometime in Aug/Sep/Oct 07), and your PD is high, there is very high chance of you getting a good news soon.

This thread is already making everyone nervous. The updates in immigration-law and also from many other attorneys might be based on the updates they get from AILA email alerts/updates. There is also a link in aila.org with title “Update on Rejection of June “Other Worker” Adjustment Applications and What This Means for July” I do not have access to review the entire article. Also EW category PD is at OCT 2001 for June and not sure if there were so many cases with that early PD and those petition was not accepted due to unavailability of the visa numbers. But this incident is reported in multiple sites and this made everyone nervous that the same might happen with all the EB applications now.
Also not that all applications will be filed on first day/week of July, even though most of us get the papers to attorney’s by now, I think they will file only a limited number of applications everyday. Some big law firms have already instructed the clients to not to send the documents until specifically requested by the attorney assigned for the individual cases and the email states around mid July time frame to process the application.
There might be a fair chance the available visa numbers are consumed in early July or within July , Since making the VB Dates current for all categories makes me believe they would most likely accept the petitions for entire July in spite of the visa number availability until July end at least. Making VB all dates current for all categories in spite knowing the Backlog elimination center cleared a large number of LCA and with the number of PERM approvals available, and retrogression since couple of years, USCIS/ DOS / etc. will not be surprised with the number of petitions they will receive. So at least for July we can hope to be safe. We cannot change anything with regards to this and have to deal with this.

Nice post, i came to the US in 1996 for my masters, followed all rules to the T and got stuck. I am on my 4th AP and EAD (5th if you consider OPT). I think main problem is that we are trying to solve too many issues with limited ammunition. Start with a single point agenda for the short term...lets say recaptuing unused visas or something that is the least controvertial and focus on pushing it at every available opportunity. Currently we see a new proposal everyday and all they do besides encouraging debate (which is good) is motivate bystanders to distort the issue and divide the group.

Before other groups pushes for Anti h1b or gc laws. we should start somthing on recapturing or removing country cap. OR atleast some admin fixes. Last Update Date June 6 (for FP notice)
FP done June 21
No updates since then.. showing "case received and pending". It's been exact 1 month since FP but there is no change to the last update date. It is still showing June 6th. Any idea what could be happening?

Finally I got the email for Renewal EAD card production ordered.
I e-filed on june 9th, sent docs on june 11th and finger printing on July 1st. Card production ordered on Aug 13th and will update with the validity of the period once i receive the EAD card.

same here no email but online status changed to Notice mailed welcoming the new permanent resident for both of us (myself + wife)
Am July 2 Filer with notice date September 5th on reciept and Sep 4th Online
Started in EB3 August 24th 2004
Changed job and Filed in EB2 on August 24th 2006 (month and date coincidence :cool:)
Got my EB2 I140 approval first and then I got my BEC labor approved (EB3) so filed for EB3 I140
Got approved before I filed for I485
My attorney filed our I485 on July 2nd 2007 with a letter to port my EB3 date to EB2
Wrote letters again in 2008 to do the same (I was not lucky then)
Went through Congressman (Sep 2008) and got a reply that our applications are pending normal processing time and at the time of adjudications, the officer will make a determination on the issue of the two priority dates
Had a soft LUD in October 2008 for both of us on I485
Also got my EB2 I140 Hard LUD on 7/13/2008 but nothing changed just the date and also got an email with the same message.
Attorney sent an email through AILA to texas that our dates are current last month
She also sent a letter which reached USCIS on Sep 1st
She opened a SR on Sep 2nd
And today WE got it.
Thank you guys I think I did my THESIS on immigration by reading the forums in IV:D

Cam somebody please explain what ETF's are with a simple example; web definitions on it are too technical for me. Thanks
etf is very much like a pool of money that is used to buy certain set of stocks and then that set of stocks itself is divided into many equally priced units and sold to you, me and who ever wants to buy. after the "units" are sold, there are no new contributions to the pool of money and the stock composition does not change (in most cases). the exception is that in some cases, when the etf's "set of stocks" is actually a representation of an index (e.g. the SPY etf tracks s&p500), if the index itself changes (so if s&p 500 gets a new stock in it and an old stock is removed) then the etf holdings may change. to do all this crap, the company that puts together the initial pool of money charges a management fee.
the closes relative of an etf is the closed ended mutual fund. the only difference is that there is active management of the fund throughout it's life to maximize returns (i.e. stocks are bought and sold). typically, to do this crap, companies (understandably) charge more management fee.
in investor's terms, if you want direct but diversified exposure to a specific sector or specific index or specific anything of the market, then ETFs are a great instrument!
