    Thanks Guyz...I got the passport today.
    I sent thru USPS : 28 th jan 2009 priority mail
    Passport Received by Houston embassey: 29th jan 3.00 pm
    New Passport Received by Me : 2/12/2009 (11 business days)

    I think Houston is processing the cases quick....I am impressed with the turnaround time.

    Hope it helps anyone wondering about the dates.

    I only counted 7. But strangely enough, there's an approval for a 04/03/2007 PD. (The user Horus). I guess he is just very lucky!!!

    yeah 7 for EB3 total of 12 incl EB2. Horus, is one lucky guy i guess.

    EAD renewal filed for my spouse

    Filed on May 29 at TSC
    Last Update Date June 6 (for FP notice)
    FP done June 21

    No updates since then.. showing "case received and pending". It's been exact 1 month since FP but there is no change to the last update date. It is still showing June 6th. Any idea what could be happening?

    have you ever took a vacation day off faking ill-health either of yourself or somebody you know? when its convenient for us, we tend to legitimize what we do, when somebody else does it, they have to suffer. And oh no, you are not selfish, you are just jealous

    Enough is enough. I am ready to sign this.

    I have 3 real names. All were working for Cognizant. One had 3 years of exp. Cooked up with 4 years of B.Tech and totalled it as 7 years. Came on L1 as PM and applied in EB1. He got GC in less than 1 year. Other 2 had real 7 years exp and got GC's in 8 months. All were working at Client's place and NOT intra company transfers.

    I am not selfish. But I am sure this guy with 3 years exp may one day become a boss for any of us.

    This misuse will hurt the genuine cases. Shall we we go serious and complaint? I am ready to sign and submit all the proof.

    What people are doing here is basically discounting the value of education. They are questioning the point of going to college at all (or to get a graduate degree), when you can just go to a trade school and learn a programming language that gets you a job. By that logic, why study history, biology, philosophy, languages, etc., if you eventually want to be in the software industry.

    What people need to understand is that education gives you perspective. I don't directly use 95% of the education that I gained in many years of school, college and graduate studies. Does that mean it's worthless? I beg to differ, and so do my employers and people who work with me.

    A good formal education is always desirable. I have no problem with that. What I take objection to is this entitlement mentality of some folks. A degree does not entitle a person to anything. It may help people get their foot in the door, but then on, they should be judged purely by contribution and merit. This is mostly the case in US and the reason why most Indians do well here. Contrast this to an Indian system and you see all sorts of differentiation going on. An engineering graduate thinks a commerce graduate is dirt. A commerce student thinks a history student is typically retarded. An IAS officer thinks he is GOD :D. A US degree holder (of Indian origin) thinks he should be ahead of immigration line. It goes on...
    In all this, we are forgetting the actual person and attaching too much weight to an educational certificate issued by an institute/university. Education is an on going thing. It is good to have formal education, but we often forget universities are not the only sources of education and degree certificates the only credentials. Heck, even USCIS recognizes this :D.

    Ladies and gents, if anyone of you have that coveted PhD from Stanford, don't jump into water yet, thinking you can walk on it :D:D

    I was just joking..........anything that will help people signup and keep this thread on top.
    In fact I am relieved that experienced people like you and nolaIndian are coming to DC; I will need your encouragement. My dog and I have started walking 10 miles on Sat/Sun. We have also started running/walking 4 miles on weekdays.
    Sign up guys........if not for IV; at least for your health!!!
    Once you signup, you will have a deadline to work towards and that will be the greatest incentive that you can have.

    Above is the total number of LC approved with priority date between March 28, 2005 to July 31, 2006 ( My PD is July 28, 2006) on monthly basis based on the data published by PERM process.

    The first column showed the priority date. The second column showed the approved LC with the PD range but approved in FY 2006 and the third coulmn showed the number of LC with the same PD range but their Labor approved in FY 2007(as different application can approved in different times).

    If we assume that all the applicants with PD before July 1, 2005 have been approved then remaining numbers are total of 11979 with PD before July 31, 2006 and after Jun 30, 2005. If we assume that all the applications with PD before March 1, 2006 will be approved within this FY i.e before 9/30/2008 then only 4707 numbers of applications with PD between March 1, 2006 to July 31, 2006 will be left.


    Based on above data how could you assume that Cut-off Date will be back to 2004 and it will take 2/3 years to even cross the year 2005.








    I guess it is not going to move any further.
    There are more than enough applications waiting to be approved than the visa number available for ROW this year. It will move backwards to 2004 date in October when visa number for 2009 will be available.

    Remember, PERM started in March of 2005, and there are floods of LCs with PD > March' 2005. It will take 2/3 years before it can move beyond 2005.

    The dilemma is whether it is risky to change jobs during the infinite waiting period or it is risky to stick to the same employer and get frozen in time...

    That is an individual decision. You will minimize the risk by maintaining H1 status so you can appeal any untoward decision. Just make sure the new job you take up is "similar" to the current job. Unfortunately, there are no good answers here since AC21 is a (relatively) recent regulation.

    Yes, ONLY we EB3's need to be serious.

    I agree that CIR is impossible till March 2011. If one sees Americaworker.org ads in TV, I do not think law makers will listen to us. EB2 is placed in queue nicely.

    Let us debate decently and do not respond to people that start flames.

    I raised a SR yesterday and here is the email i go today

    "The status of this service request is:

    Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided "

    Has anybody received something similar? Seems canned and asking to wait for another 6 months holy cow?What is the next step Info Pass?

    I and manish flew monday morning sept 17th on a short notice to attend 11:30AM appointment and then again at 3:30 PM with nagaraj.
    We had 2 more appointments on 18th with NH senators.
    All the meetings were great and one them exceeded 30 minute schedule to 50 minutes.

    It was great to meet all the members like aman, jay, paskal, kanika, meenal, nagaraj, pappu, gopal etc.

    Paskal: Where is my beer?
    Gopal: "Don't shoot the messenger" in the situation room.
    jay: Speech pointing fingure to capitol hill behind him. "We are here on offence".
    Mike: Step1 to step 5 entertainment

    These are some, but not all, of the memorable things in DC.

    I really had to mention pappu seperately.
    He is a dedicated person to this cause and needs special mention. I really enjoyed his company in the bus on our return journey to NH. We shooted all possible questions and got convincing answers.

    Thanks again for the wonderful experience.
    It was a true vacation.:eek::eek:

    Folks if you want to know how to handle an interview... learn it from Pappu!! He was smooth (read slippery) as... soap?... hell anything that is smooth :)

    Pappu... any training you can give me? :eek:

    Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
    We need to stand united and raise awareness and sign up for the monthly recurring contribution.

    I understand that some of you do intend to contribute and have contributed generously in the past,
    But here are some mindsets, All of us fall in these 4 mindsets.

    1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
    2) I have contributed enough.
    3) I will contribute if I feel like, when I see something comming out of this effort.
    4) I do not have to contribute.

    If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can better plan.

    Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.

    Category 3) This has been discussed, I do not want to talk about this category of members.

    Category 4) Again - No Comments-

    Lets show the core team that all of us fall in the first 2 categories.

    The last thing we want the core to do is bite their fingers over funds. We do not want the core to get stressed out over funds. They have enough real work to do already.

    Inspite of being a serious team player, and a generous contributor it took me two days to sign up for the recurring monthly contribution program, so I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. But this is our last chance, I urge you to be one of the 1000 people we need for this effort.

    Kudh Kare tho balaa ; hum kare tho balaathkaar is what somebody who recently got his/her gc told me - was hard to digest, but true...

    "Real", "Worked hard", "law abiding" - done my masters and PhD - I know how people get through. Waa re waa - demanding "justice" - you are just plain jealous of other smart people. Guess its time somebody told you, just because you have a MS or a PhD doesn't make you smarter by default. Even if it did, doesn't mean you get everything first - teenagers behave better than that :) Time to grow up


    A lot of Desi Consulting Companies do these kinds of things. They can cook up any resume and any requirement.

    Real PHD guys who worked their asses off day and night in trying to publish some worth while papers are not getting consideration for EB1 and these DCC guys with a bachelors in any discipline and 5-7yrs experience can become Multi-national executives and fall under EB1.

    Nothing helps us legally working people with US Masters Degrees who have been living as law abiding citizens for years.

    One of my friends who did Bachelors with me in India came to US on h1B and actually bought his EB2 Labor back in 2005 through a DCC and now has a GC. He never even told me that he did that. He told me recently after he got his GC.

    Just cooking up stuff classifies as a multi national.I know a guy who is a business analyst on L1 visa got his GC in 6 months time in EB1 category by a well know consulting company stating him as a Manager..The guy was bragging and showing off his white card ,and telling how he got his GC in 6 months
