My attorney sent an email inquiry to DOL regarding my case. Within less than 12 hours a response was received -

Applications are processed in the order they are received. Once the Analyst reaches your case in their queue, based on the principles of FIFO (first in first out) it will be reviewed and official correspondence will be issued.
However, because each application is unique, processing times may vary depending on the specific circumstances of the case.
The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.
We apologize for the delay.

It probably wouldn't take them much longer to just approve or deny my case. It's amazing how they are quick with anything that is NOT productive. Don't you just love it when they used the term "FIFO" as though they knew what it really meant? I am a positive person but it's sad and enraging to me that I have to subject certain aspects of my life to a system so dysfunctional and about as modern as Flintstone's automobile. It's said that governments are designed to be bureaucratic, which I do not disagree with. But this system is terribly impaired and down right chaotic from time to time. That is beyond bureaucracy.
Many people in this society sometimes take on a very convenient attitude toward this issue. "If you don't like it you can leave." But on the other hand they turn around and bark just as madly when they think the government is not doing something right that matters to them. This is not about staying or leaving or any other such choices in life. This is about equal rights. This is simply about people getting their jobs done. To what's broken and what's rotten in the immigration system, I say we all work for a paycheck and we all have a job to do. Difference is I make sure I deliver what I'm paid for and you aren't capable of the same. For this reason I'll still be around right here long after you are eliminated and replaced.
Sorry for the 'rant' after I've exercised the only tool available in this situation, email inquiry to DOL, and received a totally meaningless but well expected result. Feel free to do the same then you can post it here so we can compare and see if they made any typo. I doubt they will because it has to be a simple copy-n-paste job...but again with them you never know. :o

There are too many assumptions here. How I see this situation is;
EB3 I will not move significantly unless and until oversubscribed EB2s become current. Even then, it cannot be taken as granted because the demand of EB2s can take all the spill over and be current without spilling to EB3. USCIS will eventually make the change once they see that EB3 has significant retrogression and there is a lot of noise made about it.
The solution I see is; we can make a valid presentation showing the effects of this spillover change in the long run and how EB3s will be affected seriously.
This is my take on spill over interpretation and please dont feel bad if you do not like it. Lets take it this way assume we have 40K extra visa # from EB1 and ROW categories that need to be spilled over to ICPM countries. Now you have two options
1) Spill it by PD. Which helps EB3 (I)
2) Spill it by category which helps EB2 (I) & EB2(C)
If you look at numbers EB3 I # are huge so inspite of pumping 40K into it the numbers barely inch forward. We have seen this all the way till 2007. Where as in just 2 years of spillover EB2 I has moved into 2005 with prediction of becoming current in 2-3 years.
Now if I was USCIS director and going to Senate hearing. What would I like to tell them that I have used all visa # and EB2 & EB3 are severly backlogged. Or should I say I used up all visa # and now EB1 & Eb2 are current and we have backlogs in only Eb3 category.
Just that I feel USCIS can claim more bang for buck when they spill in EB2. (just my theory not justyfying it). Also I feel Eb2 is used by large US corporations for its H1 employees especially STEM graduates working. Example Intel, Texas Instruments, Microsoft etc also large financial companies especially for employees on business side (not IT employees). There is pressure from these companies since they do not want to lose some one with business knowledge because of immigrations rules. Just look at how many times Bill Gates has shown up on Senate floor to pitch for EB immigration reform. If you make EB2 current you can shut him up since most Micro Soft employees are under Eb2 category. That way you are effectively muting the critisism againt you on senate floor.
This way USCIS can also keep these people happy since they can claim that EB2 which translates as Exceptional Ability and Advanced Degrees are now close to current. The only catch is consulting companies and outsourcing companies have sneaked large number of people into Eb2 and they have become lucky.

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa retrogression and delay in labor clearance. The Child Status Protection Act(CSPA) passed in the year 2002 hardly provides any relief to I-140 based immigration petitions. While for I-130 (for US Citizens) applicants the date of child is frozen on the date of submission of I-130 form it-self, but for employment based immigrant applicants this Act provides a complicated way to calculate the child�s age and it just provides relief for any processing delays in 1-140 clearance only. It just ignores the fact that we have years of retrogression for employment-based category. At the time when this act was passed there was no retrogression in employment-based category and lawmakers perhaps never thought of hardship, which children and families may face because of the retrogression.
We need to raise our voice on this issue too. My son is going to miss out the chance of getting his green card just because his age works out as per formula given in CSPA Act to be 21 years and 12 days � because of 12 days my family may be penalized to be separated from our child whereas no one is going to consider 3 years delay in labor case in my case and then another 13 months we have to wait for filing 1485 after approval of I-140. Mine case was the most unfortunate in the sense that I got my I-140 approval in just 29 days whereas in all cases the normal time is 3-6 months. Had it taken 2 months, my son would have got the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.

I faced this situation a year and a half ago and transferred my son to an F1 student visa. As long as he is registered for 12 credit hours in college he gets to stay in the US. I have contacted dozens of senators, congressmen etc etc and in all but two cases did not even get an acknowledgment.

PS pappu, I updated what I know exactly (PD RD of I 485), my lawyer has the rest.
I have received approval on April 04 and today I have received GCs for all my family but not for one of my daughters. I checked USCIS and I just realized her application is still pending. The second reason is fund raising. I have a fundraising goal of 5$00 this year ans starting out early will give me a higher probablity of meeting my goal or exceeding it. I am going to be writing letters to my friends/ family to contribute towards IV as early as next week. I will see if I can raise atleast 150 to 200$ by doing that. I am going to organize a summer BBQ and have a cover charge or put a donation box at the BBQ. I will see how much I can raise doing that. My third event will be around November. I was planning on partnering with some friends and baking some pie's, puff pastry's, Cookies, kebobs and selling them at a local farmers maket on a saturday. Hopefully I will raise more than $500 doing all these. This should be a fun filled year for me.

This initiative, Team IV, is slightly different, and is centered around your personal fitness goals, and having fun. The fundraising goals for each Member are so nominal that about 2-3 events should get you to your targets easily. These events do not require more than 2-3 days of planning and execution combined. In the process, you are going to have some fun as well.
All you need to do now, is sign up with Team IV. You can sustain or start your committment to fitness training and sign up for one of the Team IV or local events. The fundraising can start as late as August and you will have plenty of time to wrap it up by January 18, 2009.
I am confident that several Team IV Members will exceed their initial goals of $300 or $500.
This is a year long, fun filled, fitness oriented way to support IV!!

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I think there are more people affected by this than 50 people mentioned in this thread. My recommendations are.
1) Need to gather additional people got affected by this
2) Most of the people already contribute to IV but if we need additional funds to drive this lobbying, need to find out and start collecting additional funds
3) Need advise from IV moderators/seniors about the next step regarding lobbying or contacting the local law makers or collecting additional funds for organized lobbying.
Other information we need to find out is does any people got LCA approved after the audit? If yes, how much time it has taken after the audit?

The driver of the cab talked to me and said there was a man in a suit who forgot his blackberry in my car. And after having heard the hilarious (but obviously stressful to him) stories about him losing his bags and what not, I had no doubt in my mind who it was, so I pointed out to Aman and sure enough thats who it was. :D
Three unbelivable things had happen in DC.
1. Aman forgot his cell phone in the Cab. This phone had all the important contact information. One passenger using the cab found it and he decided to return it to the owner of the cell phone. The driver brought that passenger at the Washington Monument. The passenger asked the driver to find Aman. The driver found Aman and the cell phone was returned.
Three unbelivable things had happen in DC.
1. Aman forgot his cell phone in the Cab. This phone had all the important contact information. One passenger using the cab found it and he decided to return it to the owner of the cell phone. I'm ready to file AOS, while filling in the forms I realized that I have just one more page left in my passport which is valid for another 7 years.
- If I get a "new booklet" from the Indian Consulate, does it come with the same or different passport number?
- If it has a different passport number, does it affect the AOS application once the AOS has been filed with the previous passport details?

Same for me too!!! i got second e-mail today also. I got another e-mail on july 14th with same content. My EAD expires in 15 days and i am on EAD. I don't know What the hell is going on. I e-filed on May 8th.
same for me too !! first I thought that this was because I had opened a service request ..but now it seems this happened for everyone ..does this mean -- the previous production of card data was lost ?? I hope there is no FP again and hopefully all will get 2 year cards !!

Hi All,
I have just signed up for $20 contribution per month. Already contributed about $250 dollars until now.
I tried to get many of my friends in OHIO to enroll, but they just don't trust these efforts. I tried to convince them a lot but, they think everything will be resolved automatically and especially does not want to contribute even a $ for these kind of efforts. It's a shame on us that we tend to be the same backhome as well as here. Just use and use for free and never contribute anything back.
