How long was your I 140 pending and what is the dob of child?
Not sure if I have given full details of my sons case but here is the situation
1. In 1998 husband moved to us on L 1 visa
2. In 2000 company filed I 140 for husband and approved 2001, within one year of I 140 approval filed I 485' for all residing in the USA at that time and concurrently file I 824 for minor child abroad - was was to follow to join-
per instructions on I 485 application
3. The child's I 824 was pending at enactment of cspa with no final determination, so should be covered under limited exception
4. Oct 2002, received letter from uscis, (did NOT say son aged out) to say file new I 824 once husband had his green card. Sons age for cspa EB3 20years 8 months
It appears the file became separated, (IN error) so son's I 824 was worked before husband's file was complete
5. Sent new I 824 when hubby got green card and this was approved Aug 04
6. As , no news from consulate/NVC by Jan 05, got congressman's help and took till Oct 05 to received an e-mail from consulate to say son aged out
Was getting paperwork ready to file law suit when husband died very suddenly. They agree with 95% of our claim but say now hubby is dead so is the case.
My attorney say's we are suing for the mistakes and so not relevant that husband has since passed, I will let you know how the case goes

Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.
Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.
Me and husband will attend and also contribute. Will wait to register until get approval for time off from job. Any one going to DC from Baltimore can contact me so we can arrange car pool.

I have a couple of questions, pl let know if you have valid info.
Situation: My spouse came to US on H4 and then got converted to H1.Due to delay in pay and not a strong case, she is not willing to go for H1 visa stamping next time when she goes to India. She wasnts to go for H4 visa stamping instead.
1. Is it better to convert to H4 here and then leave for India? We feel that if it would take time to convert to H4, then instead of waiting she can work till the last day here and then quit and leave(because she wants to leave ASAP). Also changing from H1 to H4 here means submitting paystubs and other documents and more scrutiny. I think in Chennai consulate there will be less questions if applying for H4. Any thoughts, pl help?
2. If applying for H4 in Chennai, will they ask for paystubs from her previous H1 status? They shouldnt since she is applying for H4, but I still wanted to know. If they ask why do you want to change back to H4, what is the best answer?
3. Travelling on an expired visa from East coast to Chennai. If there is no time to get transit visa to travel thru Europe, which is the shortest route/best airlines to get to Chennai quickest from say, Atlanta? Pl help

Anyone received payment processing errors in the last couple of days on the E-File website? For some reason, while trying to complete payment for my AP e-file, when I try to use the credit card option, I keep getting an error that the e-filing payment processing server is unable to process payments at this time. I have been trying every hour for the last 2 days...and the stupid USCIS Customer Service number has no options to report this error...

I am opening a new thread to post all updates on the CIR. It seems today is a crucial day when the house comes in session and work on forming the committee might start. If people hear any updates you can post in this thread.
I read on immigration-law that conservative republications are trying to torpedo the CIR with a new technical legislative argument. It sure is going to be a difficult task to have this bill passed since house has republican majority and they are saying in the media that they will not have the bill passed.
"Report indicates that the House hardliners who opposed the Senate-passed S. 2611 have come up with a weapon to block the House-Senate Conference Committee and the S.2611. The weapon they have hammered out involves a constitutional issue as to whether the provision in S. 2611 that requires guest worker applicants to "pay the back taxes" as condition for the legal status constitutes a federal government's measure to raise the revenue. These hardliners argue that the U.S. Constitution mandates that any legislation to raise revenue for the government must originate in the House and S. 2611 violated the U.S. Constitution by originating such legislative bill in the Senate. When the Congress returns on Monday, there will be a see-saw fight between the S. 2611 proponents and opponents on this legal technicality issue. One wonders how the House hardliners would defend their prior violations in the past in another legislations that involved such legal technicality issues. Besides, there is no clear definition as to whether such back-tax payment requirement indeed constitutes a revenue raising measure. "

My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?
3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? Should I wait and apply for I-485 or EAD until Sept 2007?

1. If wife resigns (reason being pregnant and can�t work, FMLA is not an option) would she immediately loose her status as H1B? Would her status be H4?

Why do I get a feeling you are incapable of digesting the concept of "Law of the land". There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law�s , and that too very slightly. To put it were tersely "this is a bullshit suggestion" and is really wasting the purpose of this forum. The only reason so many people have responded is that it is "THAT RIDICULOUS"
Hallo Sir, with all due respects, if you read carefully what the original post was, you would understand that its just another frustration arising from an individual who has / would spend around 40-50% of the avg productive life to achieve identification with the country he/she has contributed tremendously. Here nor the degree matters nor the salary matters, what matters is as he mentioned how many years you have been legally permitted to remain in this country. Regarding law of land, remember that the US is very close to permitting aprox 11 million undocumented people the road to permanent residency and citizenship. For which I believe a 10 year waiting period has been prescribed with fine payment. If such a rule can be thought of, why not count the number of years you/me are in this country working to enrich the economy + maintaining the inflow of cash into the social security/medicare etc. Please dont mininterpret me to be against the policy of granting legal status to undomented workers, definetely not. Now whether what the initial post suggests is ever going to happen is questionable, but his/her request for more respect is very much justified. Nobody (doesn't matter whether you are a junior/senior/moderator) has the right to ridicule another persons opinion unless that post is deliberately aimed at ciritisizing the IV agenda. Please honor each others freedom of thought and expression, OK. Thanks.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Why do we always equate some educational qualification from some institute to capability? Remember Einstein, Bill Gates, Steve Jobs, Cornegie, Rockefeller.... list goes on.
Vow, what are you suggesting? Everybody should drop out? People like Einstein, Bill Gates etc are one in a multi-million chance, 99.9% dropouts don't fall into that category. There is a reason people from elite institutes are respected/sought after. Agreed, there may be some totally incompetent inspite of being from a Tier1 school, but whats the percentage of such people? 0.01 %?
