We do not have a set date for ending registrations. We are planning on accepting registrations all year long for Team IV. However we recommend people signing up sooner than later. Here is why I say that. The DC and Houston events have a cap on the number of participants and the sooner we sign up the better are our chances of getting a spot to participate in the event. Remember you do not have to run the entire 10 miles or entire half marathon. you can walk, run a few miles, walk the rest etc. I am working towards running the entire 13.1 miles in Houston but I will be happy even if I run half and walk the other half.
The second reason is fund raising. I have a fundraising goal of 5$00 this year ans starting out early will give me a higher probablity of meeting my goal or exceeding it. I am going to be writing letters to my friends/ family to contribute towards IV as early as next week. I will see if I can raise atleast 150 to 200$ by doing that. I am going to organize a summer BBQ and have a cover charge or put a donation box at the BBQ. I will see how much I can raise doing that. My third event will be around November. I was planning on partnering with some friends and baking some pie's, puff pastry's, Cookies, kebobs and selling them at a local farmers maket on a saturday. Hopefully I will raise more than $500 doing all these. This should be a fun filled year for me.

My husband and I are both on H1 now. My H1 will not expire until 2009 but I plan to quit my job and transfer to H4 for family reasons. Suppose I quit from H1 on June 1, 2007, what is the best time for me to file I539 to transfer to H4? Do I need to file right now or just anytime before June 1?
Another question is that if I quit H1 on June 1, but the change of status to H4 will not be approved until later, say, September 1, 2007, what will be my visa status between those time? Will I be considered out-of-status?

Passport Received by Houston embassey: 29th jan 3.00 pm
New Passport Received by Me : 2/12/2009 (11 business days)
I think Houston is processing the cases quick....I am impressed with the turnaround time.
Hope it helps anyone wondering about the dates.

From last two days I am also getting the Payment Processing error when i use the credit card option and called the Customer service, they informed send an email to E-filing.support@dhs.gov and sent an email yesterday and still didn't receive any response back. Today When i try to goto login page, now i am getting "Server is currently unavailable or down for maintenance".
Same here, I think, it took two days for USCIS E-filing support team that payment server is not working. I interpret the message "Server is currently unavailable or down for maintenance" as now the problem would be fixed.

Same here, sent 2 inquires, the response was "you will be contacted as soon as it has been processed". Nothing more for 3 monthes now, or 5 monthes since initial filing.
Same here. My labor was filed on July 07 and Audit reply was sent in August 07. Attorney has contacted DOL twice and got same standard reply. Mine was filed at Chicago though.
I have no idea why Chicago is taking this long for my labor. All of my friends who filed at Chicago after me got theirs certified. I am the only one stuck.
I think denying labor is better than keeping it stuck for almost 1 year in audit.

On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

In other words, any permanent legal resient (GC holder) who has filed taxes as a "resident alien" for five years while working in US and contributed to medicare and SS taxes should be eligible for citizenship filing.
This should be added in addition to the current criteria of "five years of continuous stay after getting GC".
What do you think?

Reading your long winded message, I have to question your rationale with respect to your argument and the sneakiness of the message. Your first post with a new id is to plead for re-capture and not work for re-intrepretation of spill over. I have seen this before. Period.

Not many will probably be pleased with what I would like state. This calls for some dispassionate introspection.
First of all, let us realize that Green Card is not a right. The rules of the game were clear when we applied and all of us were conscious of what was in store. We all applied with the hope (repeat hope) of settling in the USA. The July 2007 fiasco helped many, including myself, to file 485. The US government went out of its way to accommodate us, rolled back their decision and allowed us to file 485 at that time. We must be eternally thankful for that. There is no need for INS to fear us. We all know how many years it takes to receive a reply from any government office, back home.
To avoid wastage of visas, the INS has formulated some rules and many Indian citizens have been benefitted and will continue to benefit. The nos. have also been made transparent now. The problem with us is that we want more and more and more...Wastage of visas is not of relevance to the INS, it is of relevance to us. It is not fair to question the method of distribution or the rules behind the game. The truth is, we do not have any right to even comment, leave alone question the INS. Let us be clear about that.
It is not not correct to assume that INS rules of distribution have been made arbitrarily. Are we the only intelligent people in the world? Is it that no one has thinking capability? Come on friends, let us be patient and happy for the consideration shown by INS. May be there have been lapses in the past. But which country or which organization / individual has been absolutely infallible? So let us stop blaming and critizing INS.This is a negative approach.
Many Indians seem to get irritated when INS wants to enforce the rules. Nothing will ever happen to people who follow the rules in USA. I do not want to write in a public forum about all the tricks many do, to enter and stay here. Let us all listen to our inner voice.
The real solution would be to plead for a visa recapture. That would be a positive approach. This EB3 / EB2 argument will vertically split the forum. If we EB3 people want to push our agenda, the EB2 folks have a right to counter it and appeal to INS. Afterall, today's world is one of cold and ruthless competition. So, let us not pursue this path.
There are many EB2 candidates who have come to the US way back in 2001, but could file their Labor petitions only in 2006 or 2007 becasue they were forced to do bonded labour by the desi companies. In other words, everyone has had their share of the problems.
My humble request : LET US WORK UNITEDLY AND PLEAD FOR VISA RECAPTURE
EB3 friends, be confident. Everything will work out well!

Yeah, but the 5th item being demanded is the same as a free trip to the moon with out any flight training. In a logical and sensible world it will not work and will make this forum and organization look like have no motive or direction with every demand being considered viable., just beacuse it "sounds like a great idea" to a few folks.

Hopefully you'll get your PERM approved well before that. As soon as you get your PERM approved, make sure you file for your 140 under premium processing. IMHO, it's well worth the $1000 extra.
