When USCIS sent you the RFE notice, you would have seen "Request for Evidence". After USCIS receives your response, you would have seen the hard LUD, while the header is still for RFE. Then after some days (with in 60 days), the header changes to "Request for Evidence Response Review", while the old header "Request for Evidence" vanishes. I was in the same boat like you. I spoke to my attorney's team and they offered me the insight glimpse of working of USCIS.
I see the same status. What did your attorney say? Is it a sign of some good news or there is no such thing?

Remember we live in a Capitalistic country and its a "Dog Eat Dog" world out here. No service, No Pay. If you are out of a project and are not put in a different project and is on bench, you will be shown the exit door. This is not a country like the Indian Govt. service sector where people enjoy their life with gauranteed income and pension.
I'm not sure how you got this feeling, but let me try to explain some of the reasons about your thoughts.
1.) People might be more smarter than you might think. What takes 10 Hrs to finish a job can be done in 2 Hrs if you have great skills and is highly Productive. Working hard does not always mean you slog your ass off ...This will be counter productive. Working harder means you might not be having enough skills to complete the job or you are not smart enough to complete the job within the assigned date.
2.) There needs to be a balance between work and personal life. Do you really think people always need to care about work and no life after work?
3.) GC Issues. People are still working within the limitations of the skill sets that have been detailed in ones LC. They worked such a long time within the same skill set, its very easy for someone to complete the Job within no time based on number of years worked on that skillset.
4.) Even if someone wants to work harder, take additonal responsibilities and want to progress in their career, every one knows that they are constrained by the GC process which will discourage them to try and acheive them and no wonder we all are hooked to IV forums to make our lives better after having GC in hand.

Hi ,
My I140 approved with priority date in November 2007. My wife works for American Vendor and her 6th year on H1B would be over by October 2012. Her company is not willing to initiate GC process. Right now her job is going smooth and could go for little longer. I wanted her to continue till mid of next year and then look for H1B transfer with immidiate GC process. Now the question, Is there any rule that we should start PERM 365 days before end of 6th year? Because I heard that we should file Labor in 5th year (365 days before). I am kind of confused... Please clarify this , I really appreciate it.

There have been a number of publications that have shown that the vast majority of the "illegal" immigrants actually pay SS and Medicare taxes. They also contribute to federal and state tax regardless of the benefit that they receive from it.
Well it is against the law to employ illegals and this is enforced strictly, so we can forget about tax deduction at source, SS, etc. It will be minuscule. These so called publications are from their supporters which they have numerous of.

An American I met a few days ago was telling me about how he was unemployed for almost 3 years. He is a well educated person and didn't think it made sense for him to find low-skilled labor!
I am aware of that well publicized stunt. Do you know we have only 800K farm workers and 1.5 million farm workers were granted amnesty in 1986?
The only way to get cheap labor is with short term foreign contract labor, amnesty will never work, they have to return anyway.
The farmer will stop working in the farm, the day he gets his GC. Lets not compare an educated american. A citizen with no schooling would take the job at the right wage.
The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills.
There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.

We do need to push legislators to come up with a good immigration policy. Bashing another immigrant because they came here to do something different from you is not going to get us very far. 1) USO -- ETF for crude Oil. It is at about $29.00 but alst year in July it was about 120. IS it a good investment bet. I know I might have to hold it till summer of 2010.
2) HNSN -- Biomedical device maker. It is the next ISRG, as the reports indicate. They make the sensie robotic cartherer devices. No one else in the world does that. What do you guys think of this ? It is now at $4.50, at its peak it was about $37.00

I would change my contribution to $50 monthly if we have 1000+ members to sign up for the monthly contribution. Meanwhile, I would cancel my contribution if this goal cannot be achieved by all our 8400 members within the next two months. I cannot see any point if most people who suffer from the possibility of waiting for years would not contribute while I, who might be one of the least painful ones, contribute.

I know that females are disproportionately represented in these forums - even so.........I would like to see more women participate. Going forward, I will give $10 towards even female who signs up (upto 10 memberships). If you cannot find company, exercise with a cell phone and pepper spray on you.

Thanks for the response. I believe I should check with the school. If the school accepts just the proof of having applied for COS, then I should be fine. I dont understand if they accept F1 application proof, then why not for H4 ? Anyways thanks a lot.

After failing to get a definite answer on the exact time taken by the process of changing status to H4 while in the US, I have decided to take a trip to India to get this stamped instead. I was told that change of status to H4 needs to be approved before starting school, simply showing proof of having applied for COS is insufficient. But if you apply for change of status to F1,then approval is not required before starting school. However I would suggest you confirm this from your lawyer/school.

And sometimes sensitive information will be given by phone or to contributing members only. So all must update their profile with full information and signup for recurring contributions. We may not make sensitive updates public on the forum. This will be an incentive for people to sign up for monthly contributions.

I wouldn't pass such judgement on immigration-law.com. They've acknowledged the mistake. It's not like no one makes any mistakes, it's how they acknowledge and move forward.
Immigration-law.com has made many many many mistakes especially considering the fact that they are lawyers. Lawyers by profession hardly ever make statements, since their profession is to make sure what they state is 100% accurate. They are more like a news sensation organization, so please there is no need to defend them. But people like us that includes me want this thing to work so bad that we go to their website for our vested interest and to give us some hope. They are more like a blog than a legal web-site.

when is yr EAD expiring ? what about H1 -- if you have given up that then there is not much that you can do ..other than infopass etc. I think logically speaking ,,I should be getting EAD the fastest (there are few more like me) ..who go card prod ordered in june ..so as soon as I get it ..I will post here.

as for me ..I have a plan B ...unpaid vacation ...one of my friends had told me once ...you shd enjoy life along the road and not at the end of it :D ..USCIS is doing that for me
It is expiring on Sep 19th and I dont have H1. Im not concerned about taking unpaid vacation, but the real issue is if my employer will continue to keep me in the job. It would be really scary trying to find a new job in this market. So far I have not alerted or gave any hint to my employer. I will see when the time comes.
But the sad part is that USCIS is working in a erratic way and there is no way to find out what exactly the situation is about a particular case.
Going to infopass is not an easy task as it is 100 miles from where I live and driving to and fro without any kind of hope is useless either.
I will wait for few more days will approach the congressman office and see what they can do.

I received the card in the mail today. It was mailed in Texas on 04/14.
So here is the events from 04/10 when I received the Welcome email.

04/15 - Case approved Email (Shouldn' this be the first one they should have sent? Anyways I'm not complaining )
04/16 - Card received.
It felt so good have it finally in my hands!!!!
