    Lets look at Rep. Smith - Reclaim American Jobs Caucus | Congressman Lamar Smith (http://lamarsmith.house.gov/Issues/Issue/?IssueID=14781)
    he is against amnesty and for border control.
    --> the cir menendez bill has all the border control provisions that the republicans want (in fact, it is entirely what they want) - so one issue is addressed.
    --> illegal immigrants who are already in the country - record number of them have been deported in the 2 years under this administration (more than the republican presidents in the past!), trying to deport them all will take billions of dollars (which the govt does not have - or will it be charged on the legal immigrants?). Yes, one should not support lawbreakers, but just saying that does not solve the problems......what proposals are there that will address the illegal immigrants? nothing.
    the talking points are:
    border control, we are against amnesty. NOT GOOD ENOUGH. Provide solutions, if not a path towards legalization with due fines, what alternative do you suggest?

    --> Sounds pro legal immigrants right. For now, yes.
    --> How many of the H4 spouses said they have no intention of working in the US in the visa interview? How long before they come for us, for using the legal immigration loopholes to enter the job market? Is it fair for qualified spouses to stay home when they can contribute to the economy - absolutely not!! But in the eyes of the americans, are they taking away the jobs? absolutely!
    IF not now, these very people will come after us too..

    Based on the approval trend and VB movement, looks like USCIS is working on cases based on PD order..i know my friends who got their GC recently with PD's from Oct-Dec 2003..so hang on guys we all get there...its common to show our frustation when there is no advance in VB dates...

    This is not a bad idea. But having to wait 5 years for your citizenshipis is only a minor inconvenience compared to all the other more pressing problems we have right now with the retrogression. So I think we should be more concerned with issues like visa recapture, getting USCIS to be more efficient so the visas will not go to waste each year etc. If we can get all these things acheived then your suggestion would be a nice icing on the cake.

    I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
    IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.

    Totoro: I really liked the way you alone initiated and handled the fight against Stimulate Package - ITIN issue. You can be a true leader and helpful in many way to this/any community. People like you can make difference in people's lives.

    There are so many issues we are facing as a community. Let's pick top 3 ( OR 5 )for you to discuss with them. If there is any room, you can discuss least imp. issues as well.

    Issue NO 1: Retrogression / Backlog for EB3/EB2
    How to solve it ?
    - Visa Recapture
    - Saving visa by not issuing visas to applicant who are not current as per "Processing Times' Currently, CIS is approving many I-485s with PDs having currant but are not currant as per ' Processing Times'. 'Processing Times' needs to be respected. This will save huge number of visa for retrogressed countries.
    - Buying Visa for dependants and not counting towards annual cap. ( Easy way to reduce backlog - more than 50% visa would be saved. Will solve problem in 1-2 years. No other action required.)
    - Removing per country limit.( Requires changes in law - tough task/long shot.)
    - Buy a house and get a GC idea ( its been widely discussed in media ...)
    - Any more suggestion ?

    Issue NO: 2 Allowing people to file I-485 /EAD/AP even their PD is not current. - MUST BE DONE.
    Let's help these guys who can't file I-485/EAD as their PDs are not current. These are the people who are likely to suffer most in case of a job loss/visa issue. Even, their LCA/ I-140s are approved, it will become useless if they get fired/companies run some in problems etc. which can happen to any one in current times. Personally, I say - this should be our priority - can be fixed easily. It would also attract them to join us. A dying soldier saves other first.

    Issue NO : 4

    Issue No - 5 Allowing work-permit for H4/dependants ( Not that important but will change lives for many)

    Issue No - 6 AC21 - Helps greatly to individuals in tough times in maintaining their status. Any further modifications for AC21 ?

    You mentioned Stimulus package and ITIN issue, as I remember people with spouses having ITIN didn't get any rebate...

    I highly doubt any one with a full time job will trade enough volume for it to be cost effective to claim trader status when filing taxes. If you trade for a living,not work as a trader then it makes absolute sense to file as a trader.

    What is the advantage of claiming trader status on your tax return? I buy / sell shares on different days of the week (example: Buy on Monday, Sell on Friday). Does that make me a day trader?
    I am doing this on H1B. I do have approved EAD.

    Half the people I know (and yeah, that includes me!) are on vacation at this time... (talk about using up leave/vacation/sick time etc before the year ends :) ).

    And anyway, the ones on vacation - and ones on not - are either
    (a) Broke (holidays, gifts, parties etc)
    (b) Not checking mails and internet (ditto) or,
    (c) Want to forget their problems for at least a week or two before getting back to reality.

    Keep this thread alive.. I predict things will liven up in terms of contribution and membership in the second week of January.

    I am currently on H1B visa. My understanding is that as long as my H1B is thru my employer it is perfectly legal to start/buy/partner in a company .... as long as I do not withdraw a pay check from that company. Furthermore, as long as I am maintaining my legal status thru my American employer, it would be legitimate to sponsor an H1 for my wife, hire her in the company I own. If some one could clarify ..... is my understanding flawed ? Please provide examples/experiences. Any relevant input would be great.

    Another related question was if I change my status after starting my company to F1 .... would that be fine ? Or after I change my status to F-1, would it be fine to start my own firm/company/partnership/practice (PA/LLC/PLLC) and then transfer my wife's H-1 B in this newly created entity. FYI .... This new entity would be perfectly legitimate PA/LLC/PLLC with solid revenues/earnings/5-10 american employees .... and my wife would be fully qualified to work in this entity as a highly compensated employee providing US govt with a lot of taxes .... all done by my savings AND/OR bank loans.

    On another note, if I change my status to H4(dependent on my wife's H1) instead of F1, would the same hold good. My wife's full time H1 B would be thru an american employer. My PA/LLC/PLLC just sponser her part time H1 (2nd H1) .... you guessed it .... to start her permanent residency process. FYI .... Both of us are waiting for priority dates to get current to file I-485 .... both of us have I-140 approved from our respective employers as of now. This is an attempt to get out of their yoke and gain freedom as much as possible in these trying circumstances.

    Gurus, your expert opinion would be invaluable. Please comment.

    My situation is similar to yrs. I need some information. I am on h1b right now. My fiancee is in india and we are planning to marry in May. After that he will come here on H4 visa.
    when can he apply for H4 to h1 , we can apply only in April or anytime after he come here....
    How can he apply for H4 to H1 transfer after comming here ?
    and how long it will it take for H4 to h1 transfer......

    Please anybody reply me as soon as possible.


    Hello - I have a unique situation. I'm currently in the US on H1B, and my fiance is in India working for a reputed software company. We are planning to get married by end of April.

    I want her to come to US on a work visa (hopefully H1B). I got to know that to make the FY09 H1B cap, she has to apply for H1B on Apr 1 2008, and wait till Oct 1 to travel if her visa gets approved. But since we are getting married by end of April, I don't want her to stay in India till October while I'm here.

    The other option I was thinking was to apply for her H1B on Apr 1, but still go ahead and apply for H4 in early May, so that she can travel on H4 in May. And once her H1 is approved, she would already be in the US and can start working from Oct 1. Is this possible? Will this plan create any problems for her H4 or H1 visa application?

    If the above does not work, what are my other options? If I miss the Apr 1 2008 deadline, the next earliest she can apply for H1 is Apr 1 2009, and work from Oct 1 2009 - and I don't want to wait that long.

    Another option is to get married before Apr, get her to US on H4 before Apr, and apply for change of status to H1 on Apr 2008. But the marriage plans for Apr is made and to push the dates back would not be easy.

    Any help in this matter is appreciated.
