I wasn't born in a Hospital so they won't have a record.
I just spoke to someone at http://www.yourmaninindia.com/ and they informed me that Delhi doesn't issue Non-availability of birth record certificate.
Any other options?
Please check with your lawyer, According to my lawyer, a new BC with 07/2007 registeration date, accompanied by 2 affidavits from your parents/Uncles/Aunts should suffice.

I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.

What's so immoral about sending them to their home country without splitting families? We are not putting them in prison/guantanamo. The first amnesty was a big mistake and not justifiable. C'mon 8 billion is a expensive? Illegals cost California 10.5 billion a year in welfare, stamps, education...
There have been a number of publications that have shown that the vast majority of the "illegal" immigrants actually pay SS and Medicare taxes. They also contribute to federal and state tax regardless of the benefit that they receive from it. (Some of these publications have been presented in Congress over the years). What some of the right wing folks (like Lou Dobbs) say is that they are sucking the system dry. That is very debatable. The fact that they can only avail of emergency medical care is the fault of the system here in the US.

Not sure if you are aware that a majority of the farmers especially in the South are willing to hire American workers but have had no success. The only thing that the US DOL have managed to confirm is that there is a shortage of workers. Can some of those be filled by American workers? Sure some but not all. Its just that lots of them don't want to fill those positions for various reasons. An American I met a few days ago was telling me about how he was unemployed for almost 3 years. He is a well educated person and didn't think it made sense for him to find low-skilled labor!

The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills. You and I might be lucky that we are healthy and employer paid insurance. Millions don't have that benefit. Also consider that some people couldn't buy insurance because they had hit a "lifetime limit"! So if someone has cancer (which I might tell you is frightfully expensive to treat), and then had a relapse, you could very well hit that lifetime limit. So once you retire, you would have no recourse. Also remember that health care was declared a human right by the United Nations. (see the UNDHR Article 25)

Might well make the most of it!

Is this done before you apply for after you apply for I-485??..I called one of the doctor and they said that once you apply uscis will direct you to get the tests done...is this true??..

Big movement usually comes in June (last quarter of the fiscal year) because DOS is not good in statistics (they are hiring US citizens...just kidding, no offense meant) and only that time it realizes that there are more visas to give. And then suddenly some big VB movements (i think DOS should hire us instead as statistician....i can make accurate VB...lol).
But I believe for FY2008, big movement will come on April (DOS doesn't like a repeat of the July VB fiasco).
i agree with junRN....i think this time around the movement will be accurate because all the 485 cases have been filed (excluding BEC ppl) no labor substitution will occur, hence they will know how many visas are in hand and how many can be allotted. Although I think the movement will start from Dec as they suggested...but it will be conservative..and then get agrressive (if reqd) by april.

You should not promote your site on this site. You do not have Immigrationvoice link or banner on your site. It shows you are running your own organization without caring for IV and coming to this site to promote your site. IV agenda and your agendas are different.

Sorry your wrong about what I am trying to achieve and that is a pathway to a green card for all children and protection for any child aging out. I have tried to encourage IV to help or work on this issue and would be more than willing to assist them but it does seem their main focus is getting more H1B visa's and dealing with backlogs, but so many H1B children still age out and if their parent passes away whilst an AOS is pending the case dies with the parent, this is where a compassionate visa would come into play
The sad thing is , (or good if you view from a different angle) that there are not enough of us on this site that can take up the cause without the backing of IV

When I did it a few months ago, it took close to 90 days. And, once you submit, you are at their mercy. No information is given, phone calls always end up in 'this mailbox is full crap'.
So, if you need it much faster, I would suggest either calling them prior to submitting and checking if their times have improved or going there in person. I am not sure if that makes a difference.
The 10 day return is supposedly for people who got their passports through Houston. For passports issued in India, it may take up to 90 days.

The dates will keep moving and I bet you will be current in the June bulletin.
This is the selfish part of me speaking but I hope they don't become current but move to April 2008 or something similar.
If EB3 ROW is current then that opens up the numbers to EB3 India and China and we saw last year that India alone got 17K approvals so that cuts from the number of ROW approvals.
Again ... it's the selfish part of me ... in a perfect world, nobody would have to wait this long or make these claculations ...
I'm happy for all the people that get that "card ordered" email but I so hope to get one for myself!!!!

I do want every one to have easy access to GC. Here what you are asking does not serve any one. It only increase the backlog. If we could make them utilize unutilized visas, remove country cap, set a fixed time frame, for most part I-485 would be current allowing any one with approved I-140 to file for I-485. You might say that atleast they could get EAD and AP. But look at those who already have I-485 filed. We are all crying the our applications are there for long time. So, do you still think to have AOS even PD is not current??

Few years back, someone at USCIS, changed the good old horizontal spillover to new vertical spillover just like that (probably on some new-bee intern's suggestion). Without any legislation change, or CIR, or admin fix...
Same way, USCIS can change it back to old horizontal spillover, and EB3-I will start seeing ~15K-~20K again every year.
We should try to re-introduce this concept of horizontal spillover back in USCIS's mind.

There will be a few lucky ones indeed. Those who get I-485 cleared within 3 - 4 months. But retrogression will kick in ( as applications get approved ) and the PD of 2003,2004 etc will become valuable.
It happened in 1999-2000 when they made all the dates current for 3 months and after that it went back by 3 years.But good thing this time is that you can change the jobs after 6 months.

I think CITIZENShip years Credit or Reduction in the years is Make most sense for the highly skilled immigrant from India and China as those are the people who suffers most because of backlog and name check.
I also think we should stick to the "five year federal taxes paid" beacuse that is what they expect from normal family based GC holder. Also adding Masters and Higher degrees in the STEM fields attract possible more support.
We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.
Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.
Making it more complicated like Percent credit for before GC filing, after GC filing, after getting GC May become hard and complicated to convenince politicains who might be amending those rules.

To believe a person needs to feel that they are working for a cause that will impact their situation. Sadly this is missing and that is why EB3 people are cool about the whole meet the law maker process
Regarding the statement I repeat the IV provisions which are for ALL EB and not any specific category/country. THe problem with EB3 is the with the way the EB system/inventory is set-up. What specific steps has IV articulated to resolve the specific issue of EB3
By your own definition this is a chronic issue and what we are taught is that any issue which is chronic needs to be redressed and when it is not it becomes a big issue which cannot be handled

shows your lack of understanding of advocacy. Grass-roots advocacy works from the ground up rather than top-down.

No one in EB3 is questioning IV's sincearity. What is being question is the approach which is impacting EB3
No one is yelling out a lie. What is being articulated (Not Yelled) is the impact of IV's direction

Well what can i say it took less that 24 hours to get shot down again.
No one in EB3 is questioning IV's sincearity. What is being question is the approach which is impacting EB3
No one is yelling out a lie. What is being articulated (Not Yelled) is the impact of IV's direction
