Due to the pending caseload at NSC, the processing time of your I485 application has been extended. Allow extra time for an officer to review your application. Furthermore if all intial evidence was not included with your application or a question arose during adjudication that required a RFE additional time would be needed.
Your application remains awaiting review by an Officer and you will be notified as soon as decision is made. The service is waiting for VISA availability

My wife was stuck in namecheck during the H-4 stamping 3 years back. She gave full FP and got cleared in 6 weeks. Question i have is that i will be filing I-485 in July so is there a chance that she will be stuck in I-485 Name check as well? Anyone with experience? Also, if she get's stuck and I am cleared does the application get's stuck completely?

How can you get approved when your PD is March 10 2006 and as per August bulletein you are not current and Sep bulletin comes in to Effect only from Sep1st?

Flower campaign, I said this one week back and did not do anything on that but was requesting others to join. I did send letters twice to 6 address and sending cards again today.
How do we organize this flower camaign or anything . Shouldnt a core member start the initiative by listing the action on the headlines.
I am sure people are waiting to see Oct bulletin. But based on information we have, please be assured nothing good can be seen, unless a miracle. Wait for the next bulletin may not be as pleasant in case you are looking for a job (No I am not). Lets all shoot emails to CORE IV now, to request them to start a campaign. I think from our end that shoudl be the 1st step. Unless they get the group together, we will be headless chicken as someone said, writing in doifferent threads,

Any comment? It is a very interesting article, it look like an advice from the WSJ to the repubblican party : do not get dirty with the Immigration, becasue US citizens does not cares. I agree with that. The unemployment rate is very low, and the Agricolture business is based with the immigration labor, the same with trucking, storage and do not talk about resturant and cleaning business.

As you know my wife got approved yesterday I received her CPO mail I checked the new funky website of USCIS case status and she was at the last DOT that of card production ordered....so we heaved a sigh of relief.....BTW I was approved on Sept 3rd and I am still at Post Decision Circle....
Today we got another mail from USCIS....Notice mailed welcoming applicant blah blah...you may get card in 60 days barring any ADIT processing blah blah....and her status in that funky website moved backward two holes to "Decision" hole...
Strange ain't it...I hope it does not move backward any further for any of us...

SUB: Visa allocation for employment based third preference workers
I am one of the thousands of employment based third category worker waiting for the priority dates to be current since many years. As you must be well aware that the backlog for EB3 category, and in particular for the Indian chargeability category has been lagging behind by almost 7 years, part of which is due to heavy subscription for the category.
All through the years, heavy demand in EB3 category was in part alleviated by the spill-over visas from other categories. This was mainly due to unused visas in employment based first category, and to a lesser extent from employment based second category. For FY2008, the long standing spill-over utilization rules seems to have been changed, resulting in a drastic reduction of visas available to EB3 category.
While I am not aware of an official guidance or a memo that details the impetus behind the change, it is widely accepted in the immigrant community that AC21 legislation played a major role in the change of rules.
The immigrant community is confused by this new reading as the confluence of AC21 along with pre-existing legislations does not make the spill-over of EB1 into EB3 disappear. AC21 legislations clarifies that the visa numbers in one category must have no consumers within the same category before it be released for use by other category. That is any number within EB2 will not be granted to EB3 unless there is no demand with EB2 for that number [Do we need this additional clarification?].
Spill-over from EB1 is dictated by the original text of section <$insert section here>, which seems to state that both Eb2 and EB3 should simultaneously benefit from the additional numbers. This reading is supported by the hypothesis that the EB5 spill-over which is mentioned in EB1 has not further mention in EB2 or EB3, but still the numbers from EB5 spills further down into EB2 and EB3 when Eb1 does not fully utilize the numbers.
Furthermore, in the Visa bulletin for July 2008, it is mentioned that the spill-over numbers are required to be assigned to the longest pending case first. I assume, though not explicitly stated, that this assumes per-country caps to be reached first.
Given the current trend in the priority dates for EB3, it is very clear that the spill-over from EB1 is being denied for EB3 preference, and this is causing tremendous hardships to people who have been waiting for long periods of time. I am sure that you agree that waiting for 7 years for a green card is extremely unfortunate.
I hope you to hear back about your views on the spill-over allocation, and hopefully see some action that will alter the spill-over rules to allocate unused EB1 numbers to alleviate the wait times being seen by employment based third preference workers.

I just got an email from the Chennai consulate, 29th day from the interview, stating the visa was stamped today:
"Thank you for your e-mail.
Our records show that your visa was issued today, January 31. You
should be receiving your passport/visa soon.

Telephone: 91 44 2857 4242
Fax: 91 44 2811 2027

This means there is light at the end of the tunnel. Please have faith in your abilities, and in your God. You will hear back soon.

What about the 1,194 EB2I cases pending with PD upto 12/31/2005?
Those cases are void at least per DOS. If you look at last month (or prev 6 months) demand data from DOS .

My wife had her first time H1 visa appmt at chennai on Jan 22, 08...she got her passport back the next day at the VFS counter.
I had my visa renewal appointment at Toronto on Jan 23, 08, but I had to wait for 4 business days after interview to get my passport back. I got it only on Jan 29th.
Hope this info helps.

I had sent the four letters to different service centers. Got a reply letter back from TSC.
The letter says "Thanks you for your recent inquiry to the Texas Service Center (TSC) via letter for information regarding your case. ....." Seems like a standard letter template.
They returned my letter and even the envelope too. :)
