    Hi!

    My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).

    I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:

    1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?

    2) I noticed that the fee is:
    - 190 for application
    - 500 for fraud security
    - 750 or 1500 depending on whether there are 25 or more employees
    - $1000 premium processsing
    - $$$ for the lawyer to prepare and file the petition

    Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.

    3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?

    4) Can the entire process by done online?

    I will really appreciate it someone could help with answers to these questions.

    Response to your queries: -
    1) Yes, one can do Premium Processing even if it is for a Not-for-Profit organization. I work in a university and I did the same.

    2) USCIS does not care where the fees come from; all they care is about the right amount. Having said that, typically, the employer pays all of it - its the cost of employing a person; however, it can be split in any way between the employer and the employee with mutual understanding.

    3) I believe they do!

    4) Probably not!

    Everywhere I am seeing few EB-3 india folks showing concern about the grim outlook for EB-3 india due to retrogression, noone else care about this.

    It looks like many EB-3 RoW folks are relying on the VISA spillover to them and becoming "c" very soon....I dont see any reactions at all from those members either on or IV forums.

    Writing to US senators and Congress Reps is the way to get some relief for EB-3 india. Each one of us should write our own story and present this USCIS pending inventory to them and educate them on how long it will take for us to receive LPR status without any releif from US congress.

    VISA recapture will be easier to pass in US congress and IV should start campaign for VISA recapture. IV will receive lots of funding if they initiate this campaign as many EB-3 india folks are willing to donate for this cause.

    You hit the nail on its head. The Eb3I participation is very very less. Look at EB2 specific threads. There are 25000 views. EB3I specific threads is a mere 2000. In fact EB3I is supposed to be a biggger group.

    Here are my theories:
    - EB3I guys lost hope in IV and stopped visiting IV
    - EB3I guys work in low level jobs without access to Internet even in office or home (certainly cannot be the case)
    - EB3I does not know about IV at all for the past 4 years (hmmm...)
    - EB3I just bury their heads in sand looking for a miracle

    This is a bigger problem than the EB3I backlog problem.

    I know many guys in this forum who are regular contributers are missing here. What really is going on?

    if you are in a hurry, you can try calling them and usually at the Indian consulates, they are quite friendly and may help you out (if there is urgency and you have valid reasons).

    Honestly I don't even see a point for these discussions, polls or predictions for EB3-I. The sooner we accept we are doomed the better. The only way out is to help ourselves but I don't think many EB3's are willing to do that.
    I spoke to several in my office with earlier EB3 PD's (who might not even get GC's in the next 5-10 years !) and of course with EAD's and they have literally substituted EAD for a GC. They were once a part of IV (and some similar org's ?!) but now have completely lost hope and don't care. I tried to motivate them to join IV and support but they feel that IV does not cater to EB3's anymore. Sadly they are not even trying to port to EB2. They are just content with a job and EAD.
    So, I am not really sure how many of us are actually willing to fight ?!
    In fact it's even worse for people like me who are still waiting to file their I-485. Is it going to take us 5,10 or 20 years just to get an EAD ?!

    I agree, EB3 is doomed and I agree its better to accept the fact but dont agree that IV has forgotten EB3 (I can understand your pain).
    also as far as comprehensive Immigration reform is consodered...I would say whether anyone likes it or not. Its just for votes (fight is so as to who gets thec credit DEMs Or REPUBLICANS). I am againsit as it promotes giving amnesty to illegals.

    Don't stress out too much!!! Sleep calmly till dawn and believe me next morning will be more rewarding.
    There is one thing which all of us can do and I belive it will be more effective than a rally(And certainly will cost less).
    all we need to do is spread the problems we are facing whenever we buy high value goods like cars or homes. tell the dealer / broker / edu instituitions ..I would have closed the deal if I had a green card ..so the next time congress takes up this bill ..there would be more support for increased legal visas ...unfortunately many of us are selfish ,...we just run and buy houses as soon as we get EADs

    BTW many emails still came back undelivered after 3 days today. Such people cannot contribute money and also cannot contribute ther email address to IV. :)

    I had an infopass appointment today and that was big waste of time and i had to drive 4 hours(2 hrs each way) for this.
    They did not offer me any more information than the regular customer service.
    She told me that they have received my FP on 7/22 (although I have given mine on 6/19) and it is not unusual that my application is pending. She asked me wait for another 30 days and come back if I dont receive until then.
    I asked her if she could send an email or open an SR to the service center, and she said no saying that she will do that only after 30 days have passed beyond 90 day period.
    I asked her about the interim EAD and she did not understand what I was talking about. When I provided her about USCIS memo, she said "yeah that is what im saying, we will contact the service center for that 30days after the stipualated 90 days have passed". Basically she did not know what she was talking about.
    Im planning to contact the senator next week (this time I want to make sure that 90days have passed before I approach them)

    Interestingly she told me that many people are coming to her everyday regarding the same (EAD renewal) and that Service Centers are aware of this (although this does not make any difference to us).

    When I asked her if the case was assigned to an "officer", she told me that EADs are not assigned to officers (unlike 485) they are just reviewed and approved.

    Hopefully they will approve our eads soon so that I can atleast drive a car.

    BharatPremi and other who have put lots of time and thought analyzing-
    Can you talk a bit about ROW EB3. Do you think with PD MAY 2004, with EAD, AP on hand, should I try a new EB2 or stick with the old one?

    I don't see any problems for ROW - i think your strategy should be wait and watch (at least for the next 6 months)

    Actually today I received my CPO e-mail, so I will go down through my list! But anyway,
    1. You can contact your local congressman and explain your situation
    2. You can visit your local USCIS office through an Infopass appointment
    3. You can file an ombudsman form (google it)
    Good luck! Opening a SR was really helpful in my case.

    Mine is similar to yours. Paper filed and receipt date 4/2/2010. LUDs on 4/8/2010 and 4/13/2010 (exactly 1month till today). Still waiting.

    E-filed EAD and AP Renewal on 2nd April.. Sent documents after a week.. Received couple of LUD's and the last one on EAD application is on 04/22/10 and the application is still in Initial review. In case of AP the LUD is 04/07/10.

    Not sure if someone else is in the same boat??? Should I try calling USCIS??

    Hi

    My wife have H1B approved in 2005.Her stamping was refused on 226(g) section.She came to u.s.a on H4.Now her employer has applied for premium H4 to H1 transfer for her.

    We didnot hear anything from them.It is already 2 weeks.

    If it goes through.Does she need to go back for stamping to start working.

    How the things will be?

    How long the process will take (transfer)

    Retrogression in Various Steps of the GC process

    While January 2005 was the first time since July 2001 there was retrogression for the EB-3 category (01/01/02 for both China and India), the US continues to maintain protectionism through their immigration system.

    Retrogression in Labor Certification: Between 2002 and 2005, there was severe retrogression as far as labor certifications were concerned. Then came the PERM in March 2005 and for a couple of years, they boasted labor certification with 3 to 6 months time. Of late I think it is taking more than 6 months for LC approvals even through PERM.

    Retrogression in I-140 Approvals: I do not remember when the USCIS suspended the premium processing for I-140 but even before they did that, they managed protectionism by delaying the approval of I-140. As per some one's posting, it is now taking 14 months for an I-140 approval.

    Retrogression of I-485 Approvals: Post July 2007 VB, even a 1st year engineering student from India, studying the American immigration system, can tell you it could take years (not the current 6-9 months processing time) for approval of I-485s. The delay in approving an I-485 petition is not subject to the the July 2007 Visa Bulletin alone, it cannot also escape 'protectionism-tainted' FBI name check delay.

    I may sound like quite a pessimist, but add to all this the possible denials for PLC (permanent labor certification), I-140, EAD, AP & I-485s.

    As per pending list of Emploment based I485 published by USCIS , and per my my estimation, EB3 with PD up to Dec 2004 will be cleared on or before Sep 2010.

    Further if EB4 , EB5 , and EB6 spill over is allowed , then up to PD Sep 2005 (EB3 ) will be cleared by end of Sep 2010.
