The pdf with the pending numbers was created by a Rishi Lekhram, program manager at uscis, washington dc.

How ironic is that.
Maybe IV ought to get hold of this guy :)

Folks,
I got a call from the Ombudsman Office today morning was told that my case is in "transit". When is asked her what it means she told it is going to be reviewed by an IO. I got the similar response to my SR that "your case is pending adjudication by IO" so don't know what to make out of it in the sense that its been removed from the shelf and sitting in some pile and IO will get to it when he/she can?
Did any one get their GC approved after their case was in transit? How long did it take?

Isn't it strange, card production ordered mail and Physical card on the same day.
Actually he got his card first and then later in day CPO email came in. Very strange indeed.

It is fine for you NOW that you received your GC now and "see" the plight of IO. You are drinking cool aid now under the awnings of Green card. It is now tough for you to understand the plight of the people on "this" side as you crossed over to the "other"side. It is the same old story of people who got their GC and Citizenship dont care about the people who are going to wait for dog long years. Imagine what would have you done, if you didn't receive your GC in 15 days time, i am sure that by this time you would have shaked the earth from heaven to hell by calling your senators, ombudsman, alderman, congressmen etc. Instead of giving advice to others to understand the plight of IO's, keep your emotions under check and encourage others to do their best. Do not post unnecessary comments.
buddyinsd is a crap. dont even bother responding to him... his grey matter sends him a signal to go to any thread and vomit. when put in ignore he starts barking to gain attention.
On the other hand i would strongly encourage people to do what they can do. in my example i have done what a person can do maximum and got positive results. I have even got a phone call from secretary janet's office. loosers like buddyinsd will discourage people to take action for there green card but you guys dont have to stop. it is your fight not this losser's fight.

Why don't you dispute the charges. Dispute the amout that they overcharged. Then Credit Card company will refund you that amount and deal with Embassy themselves. Which card did you use to pay (AMEX/V/MC). AMEX is the most consumer friendly in this regards.
I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you dont have a valid US visa. (Note: If you have AP, and dont have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I dont mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the I will kill you right now look on my wifes face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and dont have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the good feeling that you experience during the days leading to your trip.
I havent given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

With all due sympathies, this is one of the funniest posts I have read in a long time....It helps to lighten up a bit every now and then considering we are all in this for a long haul...
Anyway, just wanted to let you know that I went through London back in 2004 and my experience was completely different. I went to the NYC consulate to get my TV for $50, yes just $50 and the whole paper work etc was done in less than 30min and I had to go back after 2 hours to collect my passport with a 1 year multiple entry stamped on it.
My point being, I think they have changed a lot of rules and made it more stringent after the recent security threats etc.
Getting a GC soon is our saviour

More than one of every 100 adults is in jail or prison in USA.

When confronted with facts, like a typical "skilled" indian, our man ganguteli resorts to the following
a) Stereotyping
b) Evading the questions, starts dragging in the irrelevant stuff, be it madoff or american prison system
Hey ganguteli, if you are so concerned with the law and order system in US, why don't you go back to your "arsha-bharata"? I am sure that in India incarceration is very low because lot of criminals don't go to prison, instead they rise in politics like your leaders Advani, Modi , Laloo etc. (who would have languished in a prison in any other civilized country) and become prime-minister material. :D :D
Or are you planning to pratice some white-collar crime/fraud here after getting the coveted GC - like starting a "consulting company" to import indentured servants at dirt cheap prices? :D :D
They say, idle mind is devils workshop.
Ganguteli, I must say you have proven that in this thread itself, with irrelevant, off-topic responses. :p

Will it be helpful to have an InfoPass appointment ? has anybody tried that..
My case was filed on JUly 2nd, I-140 approved at TSC, No RN, No CC, nothing.. frustrating.. everybody else in the world is getting the receipt notice and FP..
Hi wc_user,
Now USCIS is on top of July 2nd and 3rd filers, especially for the applications that were transfered from NSC to TSC. You will certainly get your receipt notices with in a week.:)

I don't know what do you mean by success. as far as media coverage is concerned, Fireign media (India, China or elsewhere) doesn't help. It's local media, which can create some usefull awareness. How does awareness in a different country helps?? I don't know why even people talking coverage about foreig media?????
Sometime back.. I also read some comment talking about involving Indian govt. in this.... Bullshit.. What does a different country's govt has to do with it!!!
Point is.. don't get too excited for having done nothing... Do something substantial and keep doing.

Allowing to file on July 02 or July 03 depends on visa numbers available which in turn depends usage the preceding month. If all the numbers are used up (meaning Immigration Officers have requested visas from DOS in the process of approving pending I-485) they cannot allow anyone to file on July 02 or July 03 and so on.
I guess currently race is on from USCIS to consume Visa numbers (40,000 or so) from DOS at unprecedented pace. That's why bulletin hasn't changed as yet. USCIS on its part is possibly trying to avoid flood of application at all cost, even if it requires working extra hours (and approving as many cases as possible) if it can save them later. DOS will NOT move the date back until the numbers are used up or near used up. I guess race is on....we will know on Monday. One way to know how true this is will be watching I-485 approvals from now till Monday. We are caught in the tug of war between USCIS and DOS. CIRCus isn't over yesterday....it is back in town again !!!
For the nth time.. numbers are reduced only after approval and not based on receipt of application. So if you can submit it on July 2nd you submit it on 3rd and so on.

Yes, the same law can be interpreted like this:
EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW
Same for each country.
But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?
So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.
So where is the correct interpretation? Does any body know?
Don't take me wrong here. I don't favor EB3-ROW or any particular category. I am EB3-I with PD Nov 2002.
The bottom line is that there should not exist such severe retrogression and that is what all of us should work to remove. But the law is what it is -
The law makes allotment between categories (EB1, EB2 and EB3) in Sec. 203 of the INA. Section 202 talks about country limit (note the exception clause which provides for the parallel distribution as the country limit becomes invalid if more visas are available in a category than is consumed using per country limitation).
Excerpt from Section 202 of the INA
(2) Per country levels for family-sponsored and employment-based immigrants. - Subject to 1a/ paragraphs (3), (4), and (5) the total number of immigrant visas made available to natives of any single foreign state or dependent area under subsections (a) and (b) of section 203 in any fiscal year may not exceed 7 percent (in the case of a single foreign state) or 2 percent (in the case of a dependent area) of the total number of such visas made available under such subsections in that fiscal year.
(3) Exception if additional visas available. - If because of the application of paragraph (2) with respect to one or more foreign states or dependent areas, the total number of visas available under both subsections (a) and (b) of section 203 for a calendar quarter exceeds the number of qualified immigrants who otherwise may be issued such a visa, paragraph (2) shall not apply to visas made available to such states or areas during the remainder of such calendar quarter.

Hello,
Citizen of India.
1st H1 valid until Sept 2008.
Consultate for CP will be Mumbai, India.
I have a couple of questions pertaining to GC.
My LC is approved 2 days back (Filed - May 17, Approved - May 25) I didnt know this happens so fast. We have not yet received the cetitified documents from the department so I dont know whether its EB2 or EB3.
My lawyer says it is upto the department to decide whether my case comes under EB2 or EB3? Is this right?
Now we plan to file the I-140 in June 07. Should I go for premium processing right from the first time? My company is ready to do this. But someone said on one of these websites that this creates a suspicion in the minds of the department. I dont know how true this is?
I am thinking to opt for Consular Processing. What do you recommend on this?
I have read that we can also file I-140/485 concurrently. What does that mean? I was under the impression that first I-140 needs to be approved and only then we can file the other papers.
I read in one of the posts that the 485 and EAD were approved becore I-140. How is that possible?
Now the main thing that is bothering me is the financial situation of the company. They have good money and they can afford to pay me well, but the old accountant messed up big time and filed all wrong taxes and di not maintain proper records etc. So on papers its not such a great company, but they have money for sure. How can this be a hurdle?
All your help will be highly appreciated.
Thank You.

Do we send the 485 forms for dependents and petitioner in the same envelope or different?
Do we send one check for applicable fees for both?
what should be answer to question for dependent and petitioner? PART 2: applicant information I am applying for an adjustment to permanent resident status because:

Sorry to hear this, but what is the violation you are referring to. I thot, L1s can be employed in the US on client projects by consulting companies, big or small. Sorry if i dont understand the visa rules here
Hi Guys,
I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.
Thanks in Advance,
Srini

The glitch is - once you have started using EAD and you apply for h1 - you have to get it stamped before you can use it ie your h1 approval comes without a i 94 extension - the costs towards going out - getting visa appointment , stamping etc.... are to be considered, and remember stamping in Canada and Mexico is not easy these days.
Chandu, what if a person has used only 4 out of total 6 years of H1 period. Still it needs stamping?
