Just the other day I was dreaming that Obama will pass a rule that all those who are here in US legally for 10 years + will get citizenship....:):) Maybe I was dreaming too much...

makes sense now.. EB3 I was 3576 in 2008 due to the spillover rule change. For 2006 and earlier Eb3 and EB2 were roughly the same?
2007 was an anomaly due to the June fiasco. On the other hand the 7% limit was not applied in 2007. It is pretty clear that they do whatever they want.

Hi Guys,
Please find the details of how we complaint to our client management regarding L1 violation ....(for some of you guys who are interested in educating uer clients)
Step 1. Collect the email id of uer CEO and 8-10 executive managers, make sure that your groups CIO/CTO s email ids are included, get the email id of HR Head/Legal Dept/Immigration Dept of your client (CC them in the email).
Step 2. Create an anonymous Id with something like "Against Fruad"
Step 3. Formulate the email as given below
Subject: Fradulant Activity by Vendor - CTZ Tech Solutions ...For Eg.:-)
First Paragraph: What the Fraud/Violation Is?:
Mention the L-1B violation by these companies and how these resources are legally prohibited from working on staff augmentation assignments, mention the L1 reform act of 2004, provide the link to USCIS website and attach the .pdf file with L1 reform act. Mention the list of employees at the bottom of the email.
Second Pargaraph: Why They Do This?: Key points .. NO wage restrictions, NO numerical limitation and mention the H1 visa lottery in 2006,07,08 etc. NEVER talk abt corporate greed in this whole email (hope u got why!).
Third Paragraph: How they do this?: Mention about the petition which has to do nothing the current project they work on and the visa interview where these guys tell abt someother projects and clearly mention how they gets deployed to projects where they don't have eligibility to work and skills they cannot be utilized for.
Fourth Paragraph: How to Prevent this: (To show that you are sending this to resolve an issue and not to complicate one) ... mention about how easily each hiring manager can avoid this by setting visa criterion for all jobs including contract and temporary jobs.. once criterion is set by hiring managers these vendors cannot violate the same. For Eg. Hiring managers set the criterion that a new contract position can only be filled by Citizens/Green Cards/EAD/H1 s... so L1 violation doesnt even come into picture.

Mention the NAME of atleast 5 resources (and their organisation) working on L1, their projects, technology on which they work and how they violate L1 by working on these projects and technologies.

I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.

This is what I did -
1. Had my lawyer followup with consulate -they respond quickly to that.
2. Letter from congressman - congressman called consulate and i got a written reply from congressman on status in less than a week
3. Email followup with consulate
4. Calls to DOS - have to be on hold for a bit though..
Interview - Jan 3; 221g (pink) Phd in bio; additional info submitted - Jan 7th; consulate sent info to DOS - Jan 14th; DOS clearance - Jan 31st. Visa issued - Feb 6th...

At first, I thought my friend was just scaring me by suggesting the senator/congressman route, but seeing your case now I feel foolish as I should've been doing this in early January. I will check my status tomorrow (monday) with the Delhi consulate once more, and then, if need be (fingers crossed), will talk to my boss in Houston about your suggestions regarding congressman's letter. By the way, what if I call DOS tomorrow and they say the I've been cleared, would it still make sense to have congressman approach them? Too many questions, I know, but I guess you know this feeling. Thanks again.

No I don't. You basically don't want to keep the door open wide. Once you are IN you want the door to be closed. You don't worry about loosing US jobs to India/China, but you don't want Indians/Chinese to enter USA and enjoy the "quality of life" you enjoy here.

You are getting dangerously accustomed to the "taking things for granted" style. You are loosing your competitive skills.
I personally know that more energetic people coming in is kind of dangerous even for my job safety-net (basically I cannot take things for granted). But I still have not learned to think beyond humanity, and I believe sharing is good. The new guys also deserve the chance for American dream.
And I don't forget that I was also once in H1B, and came with a lot of dreams and skills.
However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.

In essence what the memo seems to state is that I can have another employer file an I-140 petition, and if approved, simply substitute the I-140 in my existing I-485.
Is that right?

It is possible to use your new approved 140(EB2). Your date are current and do request USCIS and go in front of GC line. Good luck.

Did any one get their GCs WITHOUT getting the CPO email? I got PDA emails Sep 11 (saying that they have approved the I485 applications), followed by SLUDs Sep 13. I didn't get any CPO email or other notification. Should I expect the CPO emails and THEN the GCs, or just simply the GCs?

There is no contract to change the plans. I just spoke to Vonage customer service. She clearly explained me about the contract requirements. In fact there is no commitment for the new users also. The 1-year contract which shows on the website is for the Phone Adapter. They only charge for the phone adapter if you discontinue your service before 1 year. No strings for the existing customers.

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

Based on what the person from Rep. Lofgren's office said "there would be vote in two months", does it mean really the Sept. 26 is not "the last" date for this congress? Would there be a lame duck session? And then of course for all the politicians lame duck session would be the best opportunity to tackle this.

Obviously this is becoming an uphill battle but there is still some hope. The only and I repeat "the only" thing that we can do is contact all the judiciary committee members and express support. I feel we should also call Lofgren's office, Sensenbrenner's office, Pelosi's office to express support.
Please note that the very fact that McCain is a republican nominee proves that these NumberUSA and FAIR are minorities even in extreme right wingers. They are just noisy.
But as I have said our call campaign has been pathetic and we should be doing at least 100 times better.

Folks, first of all don't try to slam me for posting this.. Here is a note that I got from my law firm Paul Hastings.. I am subscribed to their immigration related email.. I got this today.. While this has come as a shock to me, they are still preparing to file my I485.. I did not hear this from my lawyer personally, but only through this newsletter. I will speak to them about this first thing monday morning. Please read the note entirely.. Has anybody else heard about this..
Update on Adjustment Filings for July
Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.
This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. Update on Adjustment Filings for July
Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.
This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

It is an unnecessary burden to keep renewing temporary visas year after year and face an element of risk every time I return from international travel; but the worst of all is that wait times are becoming longer and longer, sometimes 6-12 years, and I will be forced to start the entire process over again if I choose to accept a promotion anytime in between. The broken legal immigration system is badly in need of fixes.
Mr. President, your Domestic Policy Council has recognized the importance of employment-based immigration in the February 2006 report on the American Competitiveness Initiative which states:
"The President also recognizes that enabling the world's most talented and hardest-working individuals to put their skills to work for America will increase our entrepreneurship and our international competitiveness, and will net many high-paying jobs for all Americans. The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals."
I appeal to you, Mr. President, to facilitate the retention of the best and brightest from around the world by executing the following administrative fixes as an immediate interim measure:
• Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
• Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
• Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
• Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
• Allow visa revalidation in the United States.
• Reinstate premium processing of Immigrant Petitions.
I am only one among over 500000 highly skilled immigrants represented by Immigration Voice, and we are all counting on you to give us this much needed breathing room while we wait in line to live our American dream.

I think it is the part of their process. I went an infopass the other morning and the IO gave me the same response. She said every thing was fine with my application. It was pre-adjudicated and now waiting for a review now that my priority date is current. She asked me to wait for 60-90 days. But I got the approval same afternoon :)
Today I and my wife had an infopass appointment and were told that our I485 case is in Adjudication review and should expect an interview soon. I asked the officer is there anything wrong and he replied back that everything is fine. I am not sure what adjudication review is and why there is an interview if everything is fine :confused:
We also opened SR on 9/1/2010 and I got the response today for the SR request and it has the following details
"Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter." Does this mean that we will not get the GC atleast in the next 60 days?
Did anyone had an interview before or anyone know what should we expect in the interview.

Please keep writing. As many posters already pointed out - economy is getting worse and changing job may become a necessity to many of us. We cannot afford to jeopardize our green card process - if our old employer withdraws I140. Our only way is to raise and get enough attention to this issue so something is done quickly before it becomes a norm.
(I dont mean to start a ticker here on economy but following events in the recent past speak for themselves. Bankruptcies: Circuit City, LinenNThings, LehmanBrothers. Restructuring/Layoffs: AIG, MerrilLynch, Yahoo, Nortel, Cadence, eBay, Nokia, etc. Official Hiring freeze: Cisco, etc. Unoffical hiring freeze: Google (in many divisions) and a lot of medium sized companies) Look an active ticker at: http://news.cnet.com/tech-layoffs/
