I'm currently working on an H1B (12th year) for my original sponsorer. I also have an EAD which i have not used yet. My spouse is working on an EAD.
I'm planning to start a new business with a couple of friends of mine (who are GCs and citizens). How do i go about it?
Do i have to make my wife a co-owner and work in this venture as a 1099 or can i be a co-owner in this company and use my EAD for it? Please note that i do not want to quit my full-time current job with my employer(sponsorer).
Any help on this would be appreciated.

The parent company bought another company B recently and have asked me move to B for business reasons in a similar role as with company A. Could I file a new GC with B and use my 10+ years experience with A to file for under EB2. I am currently under EB3-I category

My labor certification was filed in December '07 and is in the process of audit (Fragomen law firm issue). Meanwhile, there is news that my company is being sold off. Will I be able to continue my GC process if the company gets sold off but I am able to retain the same job and title.
Is anyone else facing a similar situation? What are my options here?

All,
My 4 years and 2 months on H1B will finish in this November and we are in the process of applying for an extension. I have my 140 approved and waiting for my priority date to become current.
Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).
Also, please can you specify the USCIS rule under which it is applicable?

It is always recommended to renew both EAD and AP together, though you can chose to renew only AP.
My guess is that 120 day rule applies to EAD only, and not AP.
You can renew EAD after it has expired, but again it is recommended to at least send in the application BEFORE the expiry date.

Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs
I am not totally sure. I recall reading one amendment where they mentioned 203(b) in conjunction with this - which means EB2 qualification.

--Later I get married and I cannot bring her here, but if I wait until my PD becomes current and at which point of time my spouse can be added to 485, so does my spouse need to maintain a valid non-immigrant status to be added to my 485 since she will be out of US.

Last week i received the letter about my RFE for my I140 which they received on Feb 8, 2007. I'm a EB3 category from Bangladesh.
